The following terms and conditions will be incorporated into every sale and /or delivery of goods by Nick's Clutch Service A.B.N 57 855 745 328 (called 'the Seller'). 

1. The buyer hereby acknowledges that the goods supplied by the Seller will remain the property of the Seller until the buyer has paid all sums owing to the Seller under this or any other contract. In the event of the buyer defaulting in any of the terms in this agreement including the payment of any monies due, then the Seller will have the right (without giving notice) to retake possession of the goods supplied.
2. Prices quoted by Nick's Clutch Service or published price lists are subject to change without notice, and are not binding to the Seller. The pricing of goods will be exclusive of delivery/freight charges and will be payable by the buyer. Nick's Clutch Service reserves the right to increase prices, to take into account any increase of cost to the seller.
3. Nick's Clutch Service will charge Security Deposits on goods when it is believed necessary. A Security Deposit will be refunded to the buyer only upon the return of the goods specified. No Deposit will be refunded if the goods are unserviceable for resale.
4. The buyer may return goods for credit only when the goods have not been used and received by the Seller in their original condition.
5. All new and exchange clutch kits have a warranty of 12 months or 20,000km which ever occurs first. Warranty claims will not be issued until the goods have been tested and deemed faulty by the Seller. Warranty does not apply to modified clutches and no claim will be issued unless the Flywheel has been machined.
6. Insurance is not included in the freight charge. Insurance, if required, is the responsibility of the buyer and must be arranged prior to dispatch of goods. Customers wishing to nominate a different freight company other than the one used by the Seller, must be arranged prior to despatch of the goods by the buyer.
7. Payment must be made in full at the time of purchase for non credit account customers. For credit account customers payment must be made in full within 30 days of the statement. The Seller reserves the right to withhold delivery of further goods until outstanding amounts are paid.
